In The Trees HOA Rules and Regulations adopted 5-12-2009, amended 9-6-2011
In accordance with the Park City leash law, all pets must be on a leash or inside an enclosure when outside the dwelling unit. Pet owners must use pooper scoopers or some other effective method of cleaning up after pets. Owners & Guests should report violators to Animal Control 435-615-3985.
Window Treatments- visible exterior window coverings shall be limited to horizontal wood blinds or shutters. Colors shall be of natural wood stain with light to medium shades only. Mirrored glass is not permitted.
The parking areas shall be used only for parking of private vehicles and motorcycles. No repair, lubrication or other maintenance of any kind shall take place in the parking areas. Overnight parking on Potter Ln. or anywhere in the HOA that may cause congestion or inhibit snow removal is prohibited. Long term parking of more than 48 hours is prohibited anywhere within the HOA. Recreational vehicles, including watercraft, motorhomes of all types, and oversized vehicles, (which includes any vehicle longer than 20 feet, taller than 7 feet and/or wider than 84 inches) are allowed within the Property only in connection with their loading and unloading, and only insofar and to the extent their presence in the Property is reasonably required, and in no event for any period greater than 4 hours in any 48-hour period. Contact Management if additional time is necessary for loading and unloading. Violators will be towed at their own expense.
Interior garage space cannot be altered or cluttered in any way to accommodate fewer vehicles than originally designed for.
Units 53 and 57 may park one permitted vehicle, horizontally, in front of their garage door per Plat map.
Construction During Peak Seasons. Peak Season Restrictions. Due to the disruptive nature of construction activities, modifications, improvements, or other construction (collectively, “Construction”) upon any Lot are prohibited between December 1 through April 1 (the “Peak Season”), unless approved by the Board in writing.
Off-season Requirements. The Board may require that exterior and other Construction which is particularly disruptive may be scheduled during certain portions of the Peak Seasons, or before or after the Peak Seasons, to minimize the disruption and inconvenience to other owners. Exterior Construction examples particularly disruptive include patio and window replacements. Construction dumpsters are only allowed onsite in connection with remodeling for a total 7 days.
Construction hours are 8 AM- 6 PM, Monday-Saturday. Construction is prohibited on Sundays and Holidays.
No obnoxious or offensive activity such as loud noise from a gathering, TV, radio, stereo, musical instrument, etc. shall be carried on in any Dwelling Unit or Common Areas, which may be an annoyance or nuisance to other Owners. A quiet hour will be observed from 10PM to 8AM. Special care must be taken during this period to not disturb neighbors with use of inside jetted tubs, audio equipment, appliances, musical instruments, or loud voices. Hot tubs should be used in a quiet and considerate manner. Complaints may be reported to PC Police 435-615-5500.
Trash or trash containers are prohibited outside the dwelling units for any period of time. Trash should be stored inside the garages. Dumpster lids should remain closed at all times. Hazardous materials should not be placed in dumpsters. Christmas trees should be disposed of off-site.
Garage doors should be closed at all times for security reasons and to prevent pipes from freezing.
Patio furniture must be maintained at all times and replaced as necessary. Nothing shall be hung from the patios, windows, or window sills.
Roof heat tape controls should remain on during the winter months- November 1 through April 15. Owners may be responsible for damages incurred from heat tape that is intentionally turned off during this period.
Nothing shall be done in any Dwelling Unit or in Common Areas which will impair the structural integrity of any Townhome Building or which would structurally change any such building.
Seasonal display of lights- seasonal displays are permitted from November 1 to March 31. White, non-blinking lights may be displayed, however, the displays shall not be used to create messages or advertising. Displays should be turned off at midnight. All displays must meet current Park City building codes.
Hot Tub location and size should take into consideration falling snow/ice from roof area. All tub installations and draining practices must meet current Park City regulations and codes. Disposing of hot tub water onto patios is prohibited. Tub panels shall be stained and replaced as necessary. Damaged covers and broken or missing cover locks should be replaced immediately.
Landscape- planting and removal of trees & shrubs is prohibited unless prior written approval by the Board or Management. For consistency, approved trees, shrubs and plants can be purchased from and installed by the HOA landscape contractor or approved contractor. Plants must be draught tolerant. Any new irrigation must meet local regulations and specifications. The HOA will not be held responsible for additionally installed plants that perish.
Air Conditioner Installations- the Board must approve air conditioners and installation location in writing, prior to installations. Compressor units must meet a minimum SEER rating of 13 and noise level maximum of dB 65. The Carrier brand models 38HDR side discharge or equivalent in specifications is recommended. Any deviation from this model requires Board approval.
Electronic notice- the board or management may provide notice, voting, proxies, ratifications, or communications, etc. to owners by electronic means, such as by email, text or by posting on the association’s website.
The shuttle will operate seven (7) days per week between the hours of 8:00 am and 5:00 pm during ski season. The last shuttle will depart from the Snow Park Lodge at 4:30 pm.
FREQUENCY AND LOCATION OF SERVICE. The shuttle will pass by project approximately every 20 minutes from 8:00 am until 1:00 pm. The shuttle will pick up passengers on the street in front of Potter Lane. Beginning at 1:00 pm the shuttle will primarily be located at the Snow Park Lodge in order to facilitate skiers returning to their accommodations. On the return trip, the shuttle will pick up passengers at the Snow Park Lodge and will return them to Potter Lane from which they were originally picked up.
